1) The terms of sale apply to the purchase of goods and services between the buyer (hereinafter referred to as the Consumer) and the entrepreneur FUNRENT OÜ (hereinafter also the Online Store or FUNRENT OÜ) from the funrent.ee online store.

2) In addition to these terms and conditions, legal relationships arising from the purchase of products from the Funrent online store are regulated by the Law of Obligations Act (hereinafter the Law of Obligations Act), the Consumer Protection Act (hereinafter the Consumer Protection Act) and other legislation in force in the Republic of Estonia.

3) The online store www.funrent.ee reserves the right to make changes to the terms of sale. These changes will be reflected on the website www.funrent.ee.

1) All prices listed in the online store www.funrent.ee do not include VAT. VAT is added to the product prices in the shopping cart.

2) The price of the purchase will be added to the price of the transport according to the delivery method chosen by the Consumer.

3) Prices are valid from the time the order is placed until the payment deadline for the placed order expires (7 days after the order is placed).

4) If the order is submitted before the terms of sale or prices are changed, the terms and conditions in force at the time of placing the order shall apply to the legal relationship between the Consumer and the Online Store.

5) All payments taken by Funrent OÜ are made in euros.

6) The online store FUNRENT reserves the right to make changes to sales prices. These changes will be reflected on the website www.funrent.ee.

1) Add the desired products to the shopping cart.

2) To place an order, click the "Submit a request" link in the shopping cart.

3) On the order form page, fill in the required data fields, select the delivery method that suits you and click on the "Submit a request" link.

4) When you submit a request, we will send you a confirmation that we have received it.

5) We check the availability of the products and send an offer, which the customer confirms via e-mail.

6) The goods will be shipped after payment of the invoice.

1) With the sales contract for the Goods, the Funrent online store undertakes to transfer to the Consumer the Goods that exist, are being manufactured or will be acquired by the Funrent online store in the future and to enable the transfer of ownership to the Consumer, while the Consumer undertakes to pay the Funrent online store the amount indicated on the invoice for the Goods and to accept the Goods.

2) Orders that have not been paid for will be canceled 7 days after the order was placed.

3) The sales contract enters into force after the payment made by the Consumer is received in the bank account of Funrent OÜ.

1) After the sales contract enters into force, the Funrent online store completes the order and hands it over to the company's logistics partners for delivery.

2) You can pick up the goods yourself at our warehouse at: Betooni 14a, Tallinn 13816 or Vinkli 2, Tartu. For all products that are in stock, we can offer transport within 1-5 days. For other products, according to the delivery time. For transport, we use Venipak couriers and Funrent vans.

3) The delivery terms indicated on the E-shop website are valid from the moment the order amount is received into the E-shop's bank account.

4) To ensure prompt delivery, you must be diligent and provide true and valid information when entering delivery details when placing an order.

5) The online store is not responsible for delays in the delivery of goods if the goods have been handed over to the logistics partners on time, but the delay in delivery is due to circumstances that the online store Funrent could not influence or foresee.

1) After receiving the order, the Consumer has the right to withdraw from the contract concluded in the online store within 14 days without giving a reason. The withdrawal period starts from the day the Consumer receives the goods.

2) The 14-day right of return does not apply to, among other things:

a) for goods that are made taking into account the personal needs of the customer
b) for periodicals and books, unless it is a defective copy
c) for items that cannot be returned due to their nature

3) In the event of deterioration of the condition of the item to be returned, the Consumer is liable for the decrease in value due to use of the item only if he has used the item in a way other than that necessary to ascertain the nature, properties and functioning of the item. In order to ascertain the nature, properties and functioning of the item, the Consumer should handle and use the item only in the way he would normally be allowed to do so in a store.

4) To return the goods, you must notify the Funrent Online Store of your decision within 14 days of receiving the goods with an unambiguous statement at the following address: [email protected] or using the customer support form at www.funrent.ee

5) The consumer must return the goods within 14 days of submitting the application or provide proof that he or she has handed over the goods to the logistics company within the aforementioned period.

6) Upon receipt of the withdrawal form, the Funrent online store will immediately, but no later than 14 days after the end of the period, refund all fees received from the consumer under the contract, including the costs of delivering the item used by the consumer, unless the consumer has expressly chosen a delivery method other than the cheapest delivery method offered by the entrepreneur, in which case the Online Store is not required to refund the consumer any costs that exceed the costs associated with the usual delivery method.

7) The online store may refuse to refund the money until the consumer has returned the item or provided proof that they have returned the item.

1) The Funrent online store is not liable for any damages caused to the Customer or any delay in the delivery of goods if the damage or delay in the delivery of goods is due to circumstances that the Funrent.ee online store could not influence or foresee.

1.2. The seller processes the personal data provided by the customer in accordance with the requirements established by the Personal Data Protection Act.

1.3. The personal data processed are the data requested from the customer when subscribing to the newsletter (e-mail address, when placing an order on the website (first and last name, address, telephone number, e-mail address) and the website visitor's IP address and other (network) identifiers collected using cookies.

1.4. The Seller processes the Customer's personal data primarily to fulfill orders (including for sending order-related notifications), pay for products and deliver products. We also use the data provided by the Customer and collect cookies to compile newsletters and promotional offers and to track the Customer's journey in order to provide a better customer experience. You can read more about the use of cookies in Section 2.

1.5. The Seller does not transfer the Customer's personal data to third parties, except in the following cases:

1.5.1 To the suppliers of the products included in the order (customer name and telephone number) to fulfill the order and provide customer service;

1.5.2. If the client has expressed a desire/agreed to receive newsletters, his/her personal data and e-mail address will be sent to the application under the administration of Sendsmaily OÜ for the purpose of sending the newsletter. 1.5.3. The seller may also transfer personal data to cooperation partners to fulfill legal obligations or exercise rights, for example, to the relevant service provider(s) to fulfill accounting obligations.

1.6. In the cases provided for in clause 1.5.1, the customer's personal data will be processed solely for the purpose of fulfilling the order and the authorized processors will ensure the same level of personal data protection as the seller.

1.7. The seller may also use the customer's contact information, including the customer's name, e-mail address or telephone number, to send newsletters and direct marketing messages if the customer has given permission for this. The data collected using cookies is used to generate website usage statistics and to produce targeted advertising. You can read more about the use of cookies in section 2.

1.8. The customer has the right to access his/her personal data at any time and to request that this data be changed or deleted, unless otherwise provided by law, by contacting the seller with a request at the e-mail address [email protected] 

1.9. If the customer has expressed a desire and given consent to receive newsletters and/or personalized offers prepared by the seller, the customer always has the right to withdraw this consent by sending a corresponding notification to the seller to the e-mail address [email protected] or by clicking on the link provided in each offer sent via email.

1.10. The customer has the right at any time to request the transfer of his/her personal data to another data processor by contacting the seller with a digitally signed request at the e-mail address [email protected]The seller has the right to refuse to transfer personal data directly to another data processor if the seller believes that transferring the data to a third party is not secure.

1.11. If the client finds that the processing of personal data in the funrent.ee website shopping environment violates his or her rights, the client has the right to contact the Data Protection Inspectorate and the court.

1) The Funrent online store is liable for any non-compliance with the terms and conditions of the contract or any defects in the goods sold to the Consumer that become apparent within two years from the date of delivery of the goods to the Consumer.

2) If a defect occurs, the consumer has the right to contact the Funrent online store within two months at the latest, submitting the invoice on the basis of which the purchase of the goods was paid for.

3) If a defect appears in the product, we ask you to stop using the product.

4) The repair or replacement of defective goods shall be agreed upon between the Funrent online store and the Consumer. The repair costs shall be covered by the Funrent online store.

5) The Funrent online store is not responsible for any defects in the product caused by the Consumer's fault, which have arisen as a result of improper storage of the product or use of the product for purposes other than its intended purpose.

6) If the product does not meet the requirements or has any defects, please send an e-mail to [email protected] claim, which states the name of the person who placed the order, contact phone number, order number and a precise description of the non-compliance or defect of the product.

7) A claim regarding the discovery of non-conformity or defects of a product must be submitted within two months of the discovery of the non-conformity or defect of the product.

8) All claims will be reviewed and the Consumer will be contacted as soon as possible, but no later than within 14 days of receipt of the claim.

9) The consumer has the right to demand a reduction in the purchase price or termination of the contract from the Funrent online store and a refund for the goods if the Funrent online store is unable to repair or replace the goods, the repair or replacement of the goods fails, the Funrent online store has not eliminated the defect in the goods within a reasonable time, or the consumer has been caused unjustified inconvenience.

2.1 Cookies

The Funrent.ee website uses so-called cookies. Cookies are information that is transferred from a website or a third-party web server to the user's – or customer's – web browser so that it can be found there later. Cookies can be small files or other means of storing data.

Cookies allow the information and offers on the website to be tailored to the needs of the customer. Cookies allow the seller to recognize visitors. The purpose of such recognition is to make it easier for the customer to use the funrent.ee website.

Funrent.ee uses temporary cookies. They are automatically deleted when you close the browser. These include, in particular, session cookies. Session cookies store a so-called session ID, which combines the various requests of the client's browser into a common session. This way, the client's computer can be recognized when they return to the website. With the help of such cookies, funrent.ee can ensure the operation and functions of the website.

In addition, persistent cookies are also used. They remain on the customer's computer's hard drive even after the session ends. In particular, these cookies help the seller to make its offers user-friendly.

Non-personal cookies do not transmit personal data to the seller. These include statistical cookies. They collect and report information anonymously, helping the seller understand how visitors interact with the website.

Through advertising partners, funrent.ee places advertisements on other websites in order to show the customer only advertisements that are actually of interest to him. This process uses so-called third-party cookies from such advertising partners, which are set by funrent.ee during the visit and read by the respective advertising partner. Third-party cookies are temporary files that are stored in the customer's browser for a maximum of 540 days after the last visit to the page and then expire automatically.

The customer can view and delete cookies stored on their computer, as well as configure their handling in their browser settings. For more information, contact the manufacturer or use the Help function of their web browser.

Allowing cookies is not a prerequisite for using funrent.ee. Most web browsers automatically allow cookies. If the customer does not want this, they can set their browser to notify them about cookies and allow them to be allowed on a case-by-case basis. They can also set their browser so that the computer does not save cookies, or to send a warning when a new cookie arrives. For example, some browsers offer the option to allow first-party cookies but block third-party cookies.

In addition, cookies that have already been allowed can always be deleted using the web browser or another software program. This is possible in all common web browsers. The customer can set a general blocking of cookies in their web browser settings. Blocking cookies may mean that the functions of the online offers are limited.

1) If the Online Store has refused to resolve the Consumer's complaint or the Consumer does not agree with the solution offered by the Online Store and finds that his rights have been violated or his interests have been harmed, the Consumer may file a complaint with the Consumer Complaints Commission through the Consumer Protection Board or with the court. The Consumer may file a complaint himself or through a representative.
